BSWB has extensive experience representing issuers and underwriters of all
types of business and professional liability insurance including: Directors
and Officers liability; banking and other financial institutions Errors
and Omissions liability; ERISA and other fiduciary liability; Employment
Practices Liability; mutual funds and investment adviser Errors and Omissions
liability; agents and brokers Errors and Omissions liability; and insurance
company Errors and Omissions liability. The firm’s experience extends to the
underlying liability issues, such as developing corporate governance standards
and exposures presented by the Sarbanes-Oxley Act and similar legislation.
The firm currently represents domestic and international insurers with multiple
exposures impacted by some of the most significant matters making today’s news
headlines, including: Enron, WorldCom, Healthsouth, Imclone, IPO Laddering, Research
Analyst, and Mutual Fund Market Timing matters. BSWB is also involved in many
other securities fraud and derivative cases against Fortune 500 companies, smaller
public companies, and private entities. The firm is also actively handling many matters that, while individually
may not constitute headline-grabbing exposure, are nonetheless important to our clients’ programs. Coordination among our

As monitoring and coverage counsel, the firm draws on its expertise in the substantive
areas of the law and experiences with plaintiffs’ counsel to work toward resolutions
that are satisfactory to both the insurers and their insureds. Wherever possible,
the firm works to assist its clients with the earliest possible identification
of exposures and is proactive in determining the most effective and efficient
avenues for minimization of exposures. When appropriate, the firm has the experience
and expertise to litigate and/or arbitrate coverage disputes or policy rescission
issues in the United States and abroad (see Litigation practice area). The leading
