Rachel L. Simon serves as monitoring and coverage counsel for major professional
liability insurance carriers, focusing primarily on directors and officers
liability, insurance company professional liability, financial institutions
and employment practices liability. Rachel also handles coverage-related litigation
in state and federal courts throughout the country and has handled employment-related
disputes before NASD.
Some of the significant matters Rachel has been and is currently working on
include:
pursuing a rescission claim in federal bankruptcy court against a company that has been accused of committing a massive fraud relating to the purchase of health care receivables, which has resulted in losses in the billions of dollars to bondholders, medical practices and hospitals;
defending a declaratory judgment action seeking coverage and bad faith damages against a carrier arising out of a claim for automobile diminution of value;
winning a favorable jury verdict in federal court in a declaratory judgment action seeking coverage against a major carrier for a doctor who was acting outside the scope of his duties as an emergency room physician;
monitoring securities claims arising out of the settlement of an investment bank with the New York Attorney General concerning conflicts of interests arising out of analysts' recommendations of technology and telecommunications stock;
settling securities litigation against internet service providers;
defending a declaratory judgment action arising out of a $250 million judgment under Section 16(b) of the Securities Act of 1934.
Prior to joining BSWB, Rachel was a litigation associate at a major New York
based law firm where she handled matters involving insurance, reinsurance, patent,
trademark and general commercial liability. While there, she participated in
a trial that ultimately resulted in the largest settlement payment by the State
of New York. Before attending law school, Rachel spent a year as a trial preparation
assistant with the Office of the New York District Attorney. |
