David Shedd has a strong civil litigation background representing
clients in both state and federal courts. David’s litigation experience
includes taking and defending depositions of both lay and expert witnesses
and also encompasses all aspects of pre-trial motion practice.
In conjunction with his traditional litigation experience, David
has also represented clients in many forms of alternative dispute
resolution, having played a key role in several arbitrations and mediations.
Since joining BSWB in 2005, David has represented insurers in complex
coverage matters arising from commercial line policies, including
directors’ and officers’ liability, professional liability, employment
practices liability and media liability policies, in addition to
financial institution bonds. In addition to his assistance in complex
litigation, David’s coverage work has encompassed a range of client services,
from offering legal advice on coverage issues arising from complex claims,
to effectively advocating clients’ positions in claim disputes.
Additionally, while a sizable portion of his coverage experience
arises from policies underwritten by domestic insurers, a substantial
part of David’s practice is devoted to the representation of syndicates
and companies writing domestic and Canadian policies through the London market.
As a corollary to his coverage and litigation work, David also has taken
an increasing role in assisting insurance company clients in their efforts
to offer new insurance products into the marketplace. This aspect of David’s
practice includes advising those companies on complex regulatory matters,
drafting policy language and adapting existing policy language to comport
with the nuances of each state’s particular insurance requirements.
