Defense Base Act
OverviewMr. Soler joined the firm in January 2013 as a principal. His practice includes the defense of government contractors and their insurers before the United States Department of Labor's judicial and administrative tribunals against claims arising under the Defense Base Act extension of the Longshore and Harbor Workers' Compensation Act (DBA) and/or the War Hazards Compensation Act (WHCA). Mr. Soler also advises domestic and foreign employers on issues related to employment contract formation to ensure compliance with the intricate nuances of the DBA and counsels insurers on complex coverage matters stemming from the DBA.
Mr. Soler’s practice also includes the defense of insurers, manufacturers, engineers and property owners in matters involving product liability. He has served as lead counsel in cases involving catastrophic loss due to product defects, fire and dust explosions.
Mr. Soler also has a working knowledge of the Federal Acquisition Regulation (FAR), Defense Federal Acquisition Regulation (DFAR), Competition in Contracting Act (CICA), Contract Disputes Act (CDA), and Procurement Integrity Act (PIA) as these laws and regulations pertain to government contract procurement, disputes and pre- and post-award bid protests before the U.S. Government Accountability Office (GAO), Court of Federal Claims (COFC), and government contract-issuing agencies.
Mr. Soler regularly speaks at legal education and professional development seminars across the country.

Cases of InterestSuccessfully represented insurers against claims brought by government contractor employees under the Defense Base Act extension of the Longshore and Harbor Workers' Compensation Act alleging occupational injury, infectious disease and cancer as a result of exposure to burn pits in Afghanistan.
Successfully represented private security contractors working in the Middle East pursuant to U.S. Department of Defense contracts in claims arising out of injury and death to employees of security contractors caused by insurgent activity and other combat-related conditions.
Successfully represented insurers in the recovery of $1,000,000 from the Federal Employees' Compensation Act compensation fund for expenses incurred in the defense of claims under the War Hazards Compensation Act.
Successfully represented major international resort and casino in the defense of personal injury action instituted by hotel guest.
